Adult Adoptions in Maryland and Washington, D.C.

Contrary to popular belief, it is legal to adopt an adult in Maryland and D.C.  Individuals may pursue an adult adoption to establish a parent-child relationship between two or more adult individuals. Some of the common reasons to formalize an existing relationship, often between a stepparent and a stepchild, are for sentimental reasons due to a bond between the individuals, to create inheritance rights, to minimize inheritance taxes, to provide legal protection for an adult with disabilities, and to ensure access to Social Security, military, pension, insurance, or other benefits.  

Maryland Adult Adoption

While some states have simplified the process to adopt an adult, Maryland has not.  Accordingly, the legal process is similar to that of adopting a younger child, requiring the consent of the prospective adoptee and the biological parents, if they are still living.  Consent may obtained in writing or by providing the biological parents with notice of the proceedings and an opportunity to object to the adoption.  If an objection is not filed in a timely manner, that parent will have consented to the adoption and the case may proceed to a hearing to finalize the adoption.  If the adoption is granted, a new birth certificate will be issued replacing the biological parent's name with the adoptive parent's name and reflecting any name change that is granted for the adoptee. ​

Adult Adoptions in Washington, D.C.

The District of Columbia has provided a simplified process to adopt a person over the age of eighteen.  The hopeful adoptive parent(s) must file a petition with the consent of the prospective adoptee.  If the court is satisfied that the adoption should be granted without the consent of the biological parent(s) whose rights are to be terminated, the Court may proceed to finalize the adoption.  A new birth certificate will then be issued replacing the biological parent's name with the adoptive parent's name and reflecting any name change granted for the adoptee.
